Dui, And Evading On My Motor Assisted Bicycle

Beware the cottage industry of "councilors" and "educators" you'll probably wind up spending time with.

If your first offense, you might get steered their way via plea bargain or adjudicated judgement.

But you'll still pay $$$ and have to bum rides to stupid classes that are usually all weekend long, and friday night too.

Then your car insurance is going to be insane for a while.

OTOH the "jail" isn't as bad as you think, I know people who have gone several weekends in a row. It's a halfway house style thing where you get to wear street clothes/pajamas, go to bed early, and stay freakin sober.

My take on the "system" is it's run by teetotallers, who love to find an excuse to get someone on the wagon, puppettering moronic politicians who want to look "tough" on something everyone can agree on.

Might be worth pleading for leniency, as your lightweight bike would have been unlikely to injure another worse than it injured you. The "leniency" would probably be a lame plea deal I described above.


I agree, it wasn't like i was out to kill someone, only myself if worse came to worse. I don't drive a vehicle when intoxicated, I just made a bad decision to take my bike around the block at the wrong time. Im still awaiting on the paper work, like i said i'll keep you all posted on my sentince. Instead of DUI there should be a more leanient fine called PUI ( pedaling under the influence) Nothing more than a misdimeanor) <(SP). But I guess the state needs the most money they can get. That really sucks man. We all make mistakes. Some of us make bigger mistakes than others. Trust me. I have gotten myself into a LOT more trouble than you have (I think). I learned the hard way. I used to drive drunk and flee officers all the time with my car. I finally did get caught a few times. Never in the action. One time they got my plate, and supposedly a description of me, and the other time they found me hiding in the woods hours after I outran a state trooper. It was stupid. I wish I could take it all back. You will be ok. You will get slapped on the wrist, and learn an important lesson. Good luck!
 
when i saw the subject-line, i froze...whoo...when i saw how you presented it, well, my hat's off to you...i'm glad you see the errors & i won't preach, much. and i applaud the mature discussion so far by the other riders, too.

hey, a cager gets nailed for dui & evading, what do we all say about it? matter of fact, some riders wound up being riders because of that.

just because we enjoy a bit of rebellious immunity with our mb's, it doesn't mean we're immune, too...it sorta means we have to behave even better still...IF we wanna keep riding, that is.

hot70cc, take the same attitude of remorse and self-accountibility with you to court, it's not much but it is your best bet. and i'll wish you luck, because i think you might be needing some...keep us posted.

I still ride looking over my shoulder, with my thumb next to the kill switch. And I do tend to go for spins after dinner, post-beer. Your story will help to remind me that I'm riding a motor vehicle, and NOT to drink first. :oops:

Here in PA, our mb's are more like toys. We tend to think "it's just a toy", as they have no license plate and no insurance. Just start it up like a mower, and start cuttin'. Maybe someday, as gas hits 7.00 per gal, we will have our mb's here legally.
In a bordering state like Maryland, anyone can ride one, and NO plates or registration are needed. Just a regular standard driver's license. Heaven.:cool:

Can you even get a DUI on a bicycle? I used to take my bike to the bar, just because I thought it would be legal to get home that way. Anyway, don't worry, it wasn't that bad, everyone makes mistakes.

That is not legal because you are still drunk in public. You just cant win.....

yes! I had a friend who got one. As long as you're on the road, you can get in trouble for it. The thing is, most cops won't bother with a biker unless he's being a huge idiot, or is doing something to make himself stand out. I'd venture to guess that these little motors sure make us stand out.

My friend was not only drunk on a bike, but drinking on a bike. He made the mistake of taking a pull from a bottle of Jack right as a cop drove by. Not smart.
 
My understanding in the states I've lived in is that bicyclists must follow all the laws that motorists are operating under. So this includes DUI and DWI, etc.

I'll bet its the same everywhere.

but like the poster above said, the cops usually won't mess with a bicyclist unless he's standing out somehow. In fact, they're probably happy that a guy who's been at the bar for a few hours is bicycling instead of driving. Unless he's drawing attention to himself.

But I used to bicycle up to the bar. Often closed it, for that matter. And the local cops must have figured out what I was up to. They knew me. So I guess you just gotta keep a low profile. Just like motor assisted bicycling.
 
thats not being a good ambasador for motorized bicycles kick yourself in the behind with both feet at the same time!!
