You can find a larger 4 stroke engine, gently used, many times for 1/3 of that price. I got my 98cc Lifan flathead for $50.

The majority of states here in America require 50 cc or less to be street legal but not all them do. If being street legal is important to you then you pay what you have to. A ticket for operating an improper vehicle on the public road ways might cost you more than a legal engine.

Granted many states won't bother you as long as you obey the traffic laws but not states are like that. But if you should break a traffic law and a cop sees you, it'll be just one more thing they can add to a ticket. Many cops aren't as stupid as people want to believe they are. Then there's accidents especially if it was your fault. My brother and X-brother-in-law both have been charged with operating an improper vehicle on the public road ways. For this reason I build legal bikes for my personal use.
 
If legality is a concern, don't spend $150 just for an engine. Get a 2 stroke kit for $135-150, or get a 4 stroke kit for $400. Spending $150 on an engine alone, even for legal reasons, is not economical whatsoever.
 
Japanese 4 strokes engines alone can be $400. HauSheng 49 cc engine will cost $150. It seems 49 cc 4 strokes are jacked up in price because dealers know the legal requirements for mopeds. As a result we suffer for it.

First of all I haven't said anything bad about Darwin. Butterbean asked a simple question and I gave a simple answer. I even pointed out the price is in line or lower than other 4 strokes. I also stated my opinion as to why I believe 49 cc or less 4 strokes are higher than a lot of larger 4 stroke engines. The intent wasn't to turn the tread into a legal discussion but rather answer a question and respond to a statement.

Our forum is here for open discussion so that discoveries can be made. Just like we have guidelines for being in the proper section; we also have etiquette guidelines as well. By the way I've personally spent way beyond $400 on my bike. I'm totally in agreement with you on that part it is your money spend it on what you want to.
