Oregon laws help

Hi I might become part of this community however I am getting conflicting information about how legal the bikes are in Oregon. Ive seen a few for sale and the sellers say they are legal. when I go to different vendor sites they say they are legal in Oregon, but when I go to the Oregon dmv site it looks like they need to be licenced and a licence to ride on the street. any advice would be a hlep

Note: A bicycle equipped with a power source may be classed as a moped if it meets all the moped requirements and also does not meet either the definition of an electric assisted bicycle as defined in ORS 801.258, or a motor assisted scooter as defined in ORS 801.348.

If the cops are any thing like Texas cops where you are supposed to have a moped license and the MB has to be under 50cc the cops never bother me.
I have been stopped 3 times in each case the cop was interested in my MB and where I got it.
in all 3 stops the cop never ask for my moped license, or about if the engines was less then 50cc.
Just loved by MB , 1 cop even pulled a car over that got a little to close to me and gave them a ticket, as I was riding by I heard the cop say you got a little to close to that bicycle, I just smiled and gave the cop a thumbs up

I too have read the dmv stuff....but the person selling one around here says otherwise,, that's why I was in hopes of a fellow Oregon rider would reply, other than the one trying to sell his...... guess I wont order one yet And as far as dealers on the web, they all make it sound like its 100% ok
 
Have you though about going electric the are smaller and cost more but make little to no noise so most cops would not know if you were peddling or not.

You are right the Internet dealers told me I did not need anything it was 100% legal thank goodness in Texas all it required was a moped license's , witch is just a written test you wonder why they just would not of told me that it was a 1 time $15.00 charge.

Just ask a cop. He will tell you

That not always true 5-6 weeks ago Paul has a cop stop him and insist he had to have insurance , for his MB.
And was going to right him a ticket and impound his MB, Paul pulled the TDOT book out and showed the officer the law 's he had it highlighted where it clearly says that any moped under 50CC did not have to have insurance. and that it says nothing at all about MB's

The cop said sorry and let him go, never told him why he stopped him.
 
Description for Oregon mopeds and motor-assisted scooters are almost the same but I think a -35cc motorized bike is more likely to be considered a motor-assisted scooter because it "Can be propelled by human or motor".

Over 35cc would probably be a motorcycle.

Oregon law specifically exempts motor-assisted scooters, electric assisted bicycles, and personal mobility devices from title and registration requirements.

But who sells a 35cc 2 stroke engine you can mount in a frame? Only thing I see is a Homelite chainsaw that you would have to southern engineer to adapt it. There are 35cc 4 stroke bicycle engines but they cost around $700.

I would just get an electric bike with a 750W or 1000W motor.
 
Oregon 59-801.345¹ Moped

Moped means a vehicle, including any bicycle equipped with a power source, other than an electric assisted bicycle as defined in ORS 801.258 (Electric assisted bicycle) or a motor assisted scooter as defined in ORS 801.348 (Motor assisted scooter), that complies with all of the following:

(1) It is designed to be operated on the ground upon wheels.

(2) It has a seat or saddle for use of the rider.

(3) It is designed to travel with not more than three wheels in contact with the ground.

(4) It is equipped with an independent power source that:

(a) Is capable of propelling the vehicle, unassisted, at a speed of not more than 30 miles per hour on a level road surface; and

(b) If the power source is a combustion engine, has a piston or rotor displacement of 35.01 to 50 cubic centimeters regardless of the number of chambers in the power source.

(5) It is equipped with a power drive system that functions directly or automatically only and does not require clutching or shifting by the operator after the system is engaged. [1983 c.338 Sec.59; 1985 c.16 Sec.19; 1997 c.400 Sec.5; 2001 c.749 Sec.25]
