In Canada each Province (ie:State) is responsible for it's own motor vehicle regulations so they vary as to what it and is not legal. In Alberta, the rules are rather vague and without clear definitions seems few law enforcement types would want to get involved with anyone riding one in a responsible manner. This does not account for the few idiots out there who draw attention to themselves by riding without helmets (something not required here but given it has a motor helps to avoid law enforcement interest) and ride at excessive speeds, in unauthorized areas, etc, etc. The only ban I can foresee in the future would be a ban on two strokes which are not by nature or design kind to the environment. I don't see the few motorized bicycles on the road being much of a problem, but I think the two stroke as a whole will eventually be banned from importation as other countries do the same. Most of these little engines come from China which I understand is starting to take a hard look at them so if they ban them in China, producers will no longer manufacture them as let's face it China is the largest market for these motors.
