Think about it... You probably can't get a DUI as a passenger on a motorcycle, as a passenger in a car, so how could you get a BUI as a passenger on a tandem bicycle?

    What does everyone think?

I wouldn't think so. But, you COULD probably be charged with public intoxication...

Interesting question- in my state, the law seems to require some sort of control over the steering....but it is by no means clear.

More than likely one would get charged (here in PA anyway) with disorderly conduct and /or public intoxication.

You have control of the balance, accelleration, and probably braking. I bet that's enough to convict if they were out to get you.

The FAA wouldn't allow the flight engineer to be sauced...
