What can be done or what can I do about the clearance of the drive chain from the frame?

I had that problem too. What I did is take the wheel off, and put a thick washer on the axle in between the chainstay and the nut on the axle. It worked good and was easy to do.
I've done that before aswell. At the moment I have a QR axle so that not an option. I do plan on upgrading to a solid chromoly axle. I also want to run the 44t for the torque verse the 36t. I thinking I'm going to have to hammer in the frame there to add clearance and save material to keep the integrity of the frame.

Dimple - but correctly done so the tube don't lose it's strength
Make a cradle for the tube so it will keep it's shape on one side , Make a DIE the shape of the dimple
Clamp (press) the DIE evenly against the tube making the dimple

Whizzer did it for belt clearance on their frames

You should NEVER use a quick release axle on a motorised bike, They are not made to take the stress.

Also that probably means your doing this on an aluminum frame bicycle, if so, your entire build is doomed to failure.
