ok the bike will start up and ride for about a minute, then stall out and wont start up due to there is no gas left!!!, when the valve is open letting the gas into the carb it just goes right through it and out the leak tube on the bottom, its not the basic carb its the one that comes with the choke and throttle already installed. is it something to do with the float? how do i fix it?

There should be a small tube running from the bottom of the float bowl up to where there is an open vent tube next to the place where the two control cables go into the carb. Kind of up on top. Hard to describe :p. This vent tube does not go to either of the two vent tubes that are side by side. Those two vent tubes should get their own tubing that runs down towards the street.

sounds like either your float level is set too low, or the needle & seat are stuck open.
if the float level is too low, the float bowl will fill up but the float will never raise enough to close the needle & seat before the float bowl floods over.
or, you could have a bad flot (too heavy) which would cause it to never raise up and close the needle & seat.

if there is a TINY peice of dirt in the needle & seat it will stick open and cause the carb to flood over.
you are using an inline fuel filter right?
do not rely on the filter that is on the petcock that goes into the gas tank. It wil lnot catch tiny peices of "whatever" may be in the tank.
these tanks come with a bunch of crud in them when they are brand new.
