TX law question please.

I am no lawyer and wouldn't pretend to be one online even if I could BUT.... per Dictionary.com, one of the definitions of "deck" is:

4 any level, tier, or vertical section, as of a structure or machine.

Now... if a pedal doesn't qualify as a "tier" ... albeit a moving one ... of a machine... I dunno what is. Also, I am confused by the definition as I would have thought "vertical" would have read as "horizontal" but that's not how it is...
 
The video provided for a "legal" motorized scooter does not show pedals which can self propel the scooter which is a requirement for a motorized scooter.
The 2 videos I posted can be kicked-propelled like any other kick scooter. In Texas, mopeds can be on streets over 35 mph with no posted minimum, motor-assisted scooters can't be.

Unless you're in the bigger cities, most small-town local Texas cops will just ask if you can spare one of those long-neck Lone Stars out of that 12-pack.
 
There's something in American jurisprudence that judges are supposed to use a definition of language that the average citizen would understand. Kinda sorta like "porn, very difficult to describe in words but when you see it you know it" [SCOTUS AJ Blackburn]. A deck is a flat surface to put your feet on vs pegs/pedals.

I suppose one could make the argument to a cop or judge that pedals or pegs are a "deck'' but the objective test of the law is what a reasonable person could be expected to believe and the word "deck" implies a flat horizontal surface

Under Texas law, Sec. 551.351.(1).(A).(v) the scooter must be capable of being self propelled so you are right (if the cop or judge agrees with you)
