In Illionois a motorized bicycle is classed as a moped. A moped is defined as as vehicle with:

  • An automatic transmission.
  • An engine no more than 50 cc (2hp).
  • A maximum speed of 30 MPH & the ability to reach 20 MPH over 1 mile of distance.

License

To ride a motorized bicycle in Illionois you only need a regular IL drivers license so long as the bicycle does not exceed the above criteria.

Illinois has separate rules for mopeds, and motorized bicycles are not considered mopeds and you can't even get a motorized bicycle classified as a moped because it doesn't have a vin.

Here is the actual Illinois state statute.

Section 625 ILCS 5/1-140.15 - Low-speed Gas Bicycle
A 2 or 3-wheeled device with fully operable pedals and a gasoline motor of less than one horsepower, whose maximum speed on a paved level surface, when powered solely by such a motor while ridden by an operator who weighs 170 pounds, is less than 20 miles per hour.

So to be 1 horsepower you're looking at a 25cc engine or a low quality 35cc engine. That being said chances are if you obey all traffic laws, have pedals, and don't go over 20 mph; the police probably won't bother you regardless of the engine being used.

In the third definition you'll note that low-speed motorized bicycles are specifically excluded from being "motor vehicles" meaning you don't need a license, registration, plate or insurance just to be 16 years old or over.
Illinois does NOT consider low-speed motorized bicycles to be mopeds.
Here in Illinois low-speed motorized bicycles are commonly called DUI bikes because it is common knowledge that a license is not needed.
I know in 2012 the displacement limit was 50cc but now it says 15cc but I think this is a typo because I can find no evidence of it being changed and 15 cc is a cox model airplane engine. All the cops say it is 50cc but they are commonly wrong. Also local dealers sell a very nice 4 cycle 50cc motorized bicycle with automatic transmission, electric start that can be configured as a moped if desired. It looks just like a motorcycle with blinkers, headlight, brake lights and full suspension and operable pedals that can be removed if you convert it to a moped.
if you convert it to a moped it will go 30 mph instead of 20 but you need a one time plate and a drivers license (but not a motorcycle endorsement) and insurance.
It's called a lazer 6 and retails for about $1700

I would get one but I have gone electric because I can go 28 mph with no red tape and it's quiet. That is why i have not been active on this forum. I was and am tempted to get one though.

Yes, only if your M/B can't go faster than 20mph

Bike Berry is not wrong all the M/B kit's they sell can go faster than 20 mph and are considered Mopeds
Anton is not wrong because most all ICE M/B kits can go faster than 20 mph and are considered Mopeds

BTW how about some pics of your motorbike and engine, that you say can't go faster than 20mph and don't qualify as a Moped

Do I really need to explain the effect of wheel size and/or sprocket size on top speed?
Do you not know how throttle limiters work?
Making a low-speed gas bicycle that can go faster than 20 mph doesn't magically make it a moped in Illinois it just makes it illegal!
To be a moped it MUST have a title and vin, the secretary of state will not issue a license plate without a title and you can't get a title without a VIN. And a bicycle can't have a VIN because it is not a motor vehicle. They have in point of fact created a catch-22 where it is virtually impossible to make your own "moped". I say virtually because there could be some loophole I am unaware of but it is now up to you to find a loophole to prove anything close to a point.
. I know it is possible to get a title for a home-built motorcycle so maybe you can jump through hoops to get a moped title for a home-built moped but last I heard they wouldn't do it for a moped. Even if they did it would require an inspection by the state police and more safety equipment than bikeberry sells. That is from what I found about home building a motorcycle. Not to mention rules about using only DOT approved parts on a motor vehicle. Want to guess if bicycle wheels qualify?

Look laws change over the years. There isn't any legal clerk on this forum who keeps a vigilant watch on them to make sure their accurate and up to date. If changes are brought to the forum's attention then up date revisions can be made. This forum isn't Bikeberry. Whatever Bikeberry prints and puts out has nothing to do with this forum.

In my state Tennessee, it had no electric bicycle laws until 2021. All we had was 55-8-101(35) pertaining to a gas motorized bicycle. We still have no moped laws. A moped here is either considered a motorized bicycle, a motor-driven cycle, or a motorcycle. Just depends on the moped as to what it gets classified as.
